Terms & Conditions

1. Operator and scope

www.otter.net.in is operated by Yuhash India Private Limited, which operates the OTTER brand. These Terms govern access to the OTTER website and purchases made through it. The registered office is Kazmi House, Near Masjid, Islampur, Asansol, West Bengal โ€“ 713301, India. Customer-care and grievance details are provided on the Contact Us page.

2. Eligibility and legal capacity

You must be legally competent to enter into the relevant transaction under applicable Indian law. If you are below 18 years of age, you should not independently create a customer account or place an order; a parent or lawful guardian should transact on your behalf.

3. Customer accounts and security

You are responsible for providing accurate account information, protecting passwords and OTPs, and promptly reporting suspected unauthorised access. OTTER may temporarily restrict an account where reasonably necessary to investigate fraud, misuse or a security concern.

4. Product information and genuine leather

OTTER aims to provide accurate product identity, material, colour, dimensions, quantity and other applicable product information. Product photographs are intended to represent the product reasonably accurately, but lighting and display settings can affect perceived colour.

Natural grain, pores, tonal differences, slight colour variation and variations in finish are inherent characteristics of genuine leather. They are not, by themselves, manufacturing defects. This does not exclude a claim for faulty stitching, defective hardware, abnormal peeling attributable to manufacturing, incorrect construction, a wrong product or material, material misdescription or transit damage.

5. Prices, taxes and customer charges

Prices are displayed in Indian Rupees unless otherwise stated and are intended to be inclusive of applicable taxes. Any shipping or other customer charge applicable to the order must be shown before payment. Category-specific shipping charges and free-shipping thresholds are maintained in OTTER's operational Category Shipping Settings rather than hard-coded in these Terms.

6. Availability and genuine errors

Products are subject to availability. If a product becomes unavailable after an order is submitted, or a genuine technical, stock or pricing error prevents fulfilment, OTTER may cancel the affected item or order and return any amount already paid for it. OTTER will not intentionally use false stock information, false urgency or bait-and-switch practices to induce a purchase.

7. Orders and acceptance

Submitting an order is a request to purchase the selected products. An automated acknowledgement confirms receipt of the request but does not prevent OTTER from carrying out legitimate payment, stock, address, fraud or fulfilment checks before dispatch. If OTTER cannot fulfil an order for a genuine reason, it will communicate the cancellation and process any applicable prepaid refund.

8. Payment

Online payments may be processed through Razorpay or another configured payment provider. You must use a payment method you are authorised to use. OTTER does not ask you to provide a complete card number, CVV, UPI PIN, internet-banking password or payment OTP directly to OTTER personnel.

9. Shipping and delivery

Shipping cost, category free-shipping threshold, delivery estimate, serviceability, tracking, failed delivery and RTO are governed by the Shipping & Delivery policy. Operational category values shown there are read from the same shipping configuration used by the website.

10. Cancellation

Submit cancellation requests to OTTER, not directly to Shiprocket or a courier. If no logistics shipment has been created, an eligible cancellation may be completed directly. If a shipment exists, the request may remain pending until logistics-provider cancellation is confirmed. After dispatch, cancellation may no longer be technically possible and the applicable return process may need to be followed after delivery.

11. Returns, exchanges and refunds

Cancellations, customer returns, reverse pickup, warehouse quality check, exchanges where available, and refunds are governed by the Cancellations, Returns, Exchanges & Refunds policy. Nothing in these Terms removes remedies that cannot lawfully be excluded for defective, wrong, materially misdescribed or otherwise non-conforming goods.

12. Warranty and product care

Warranty may vary by product category and is governed by the Warranty & Product Care policy and the warranty specification shown for the relevant product. A voluntary warranty operates in addition to non-excludable statutory rights.

13. Failed delivery and RTO

If delivery cannot be completed because of repeated non-availability, refusal, incorrect or incomplete address information or another delivery failure, the shipment may be returned to OTTER. OTTER will review the returned shipment and determine the applicable support, reshipment or refund action in accordance with the published policies and circumstances.

14. Promotions and vouchers

Where OTTER offers a promotion or voucher, the material eligibility, validity, exclusions, minimum purchase, stacking, cancellation and refund consequences should be disclosed with the offer. Promotional wording does not override a customer remedy that cannot lawfully be excluded.

15. Acceptable website use

You must not use the website to commit fraud, interfere with website security, attempt unauthorised access, impersonate another person, submit malicious code, misuse another person's account or payment method, manipulate promotions through abuse, or engage in other unlawful activity.

16. Intellectual property

The OTTER name and logo, website design, original product photographs, graphics, written content and other proprietary material may be protected by intellectual-property rights. Personal shopping and ordinary reference use is permitted. Commercial reproduction, distribution or exploitation requires permission except where law allows otherwise.

17. Reviews and customer submissions

Where the website allows reviews, photographs or other customer submissions, the content must be lawful and must not infringe another person's rights or disclose unnecessary sensitive information. OTTER may moderate unlawful, fraudulent, abusive, irrelevant or rights-infringing content, but genuine negative feedback will not be removed merely because it is critical.

18. Third-party services

Payments, logistics, communications and certain technical functions may be provided by third parties. Their independent services may be subject to their own terms and privacy practices. Use of a third-party provider does not remove OTTER's own obligations where OTTER remains responsible under applicable law.

19. Liability and statutory rights

Nothing in these Terms excludes or restricts liability or consumer rights that cannot lawfully be excluded. To the extent permitted by law, OTTER is not responsible for indirect or consequential loss that was not reasonably foreseeable and did not result from a breach of a legal duty owed by OTTER. This clause does not remove remedies for defective goods, misrepresentation, unfair trade practices or other non-excludable rights.

20. Events beyond reasonable control

OTTER may be affected by genuine events beyond its reasonable control, such as severe weather, natural disaster, public emergency, government restriction, major logistics disruption, widespread network failure or comparable events. OTTER will take reasonable steps to mitigate the effect where practicable. Routine internal operational failure is not automatically treated as such an event.

21. Privacy and communications

Personal information is handled under the Privacy Policy. Service communications needed for account security, orders, payments, shipping, cancellations, returns, refunds and warranty are distinct from optional promotional communications.

22. Governing law and dispute rights

These Terms are governed by the laws of India. Nothing in these Terms prevents a consumer from approaching a competent consumer commission, court, regulator, authority or statutory grievance mechanism available under applicable law.

23. Grievance redressal

Customer complaints may be sent to support@otter.net.in or to the Grievance Officer shown on the Contact Us page. Consumer grievances are acknowledged within 48 hours and are sought to be redressed within one month in accordance with applicable e-commerce requirements.

24. Changes and effective date

OTTER may update these Terms when business practices or legal requirements change. The updated page will show its effective date. Changes will not be used retrospectively to remove rights already accrued in relation to an earlier transaction unless applicable law requires otherwise.
